Will legal guardianship take away my rights?
No. Legal guardianship does not automatically make a person legally incapable. The court assigns only the responsibilities that are necessary, and your wishes remain central to the work.
Can I suggest a particular guardian?
Yes. Under section 1816 of the German Civil Code, you may suggest a suitable person and also state whom you do not want. The guardianship court makes the final decision.
Who pays a professional legal guardian?
The remuneration is governed by law. If the person is considered without sufficient means, payment may be made from public funds. Otherwise, the court examines which assets must be used.
Can legal guardianship be avoided?
An effective and sufficient power of attorney or other suitable support may make legal guardianship unnecessary. The court examines this in each individual case.
